If you reside in the United States and received notice of the Cupertino Data Breach, you are eligible to receive benefits from this class action settlement.
If you are a Class Member and wish to receive one or more of the following Settlement Benefits, then you must file a claim no later than November 6, 2025.
Class Members are eligible to file a claim for the following benefits:
Credit Monitoring: Class Members can submit a claim for two (2) years of three-bureau credit monitoring and identity theft protection services, which shall include:
three bureau credit monitoring;
report and score;
dark web monitoring;
identity theft protection services;
identity resolution services; and
$1,000,000.00 in identity theft insurance.
Compensation for Documented Out-of-Pocket Losses: If you have incurred actual, unreimbursed losses as a result of the Data Breach, you can make a claim for reimbursement for up to $5,000.00. Examples of actual, unreimbursed expenses include:
costs and expenses spent addressing identity theft or fraud;
preventative costs including purchasing credit monitoring, placing security freezes on credit reports, or requesting copies of credit reports for review; and
other documented losses that were not reimbursed.
Class Members must include third-party documentation supporting the loss, and a brief description of the documentation describing the nature of the loss, if the nature of the loss is not apparent from the documentation alone.
Alternative Pro Rata Cash Payment: In lieu of submitting a claim for Documented Out-of-Pocket Losses, Class Members may make a claim for an Alternative Pro Rata Cash Payment from the Residual Settlement Fund.
ALL BENEFITS (AND THE AMOUNT PAID TO SETTLEMENT CLASS MEMBERS UNDER THIS SETTLEMENT) MAY BE HIGHER OR LOWER DEPENDING ON THE TOTAL AMOUNT OF APPROVED CLAIMS.

The deadline to submit a Claim Form online is November 6, 2025. If you are mailing your Claim Form, it must be mailed with a postmark date no later than November 6, 2025.
